On September 25, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution. This case was called and recalled from the calendar during the Court's October 16, 2023, Richmond, Virginia remote trial session. Both parties appeared and were heard.

Upon due consideration, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed September 25, 2023, is held in abeyance. It is further

ORDERED that this case is continued with jurisdiction retained by the undersigned. It is further

ORDERED that, on or before November 15, 2023, the parties shall file a joint status report as to the then-present status of this case.
