Noel v. Pelow

Appellate Division of the Supreme Court of New York, Fourth Department
May 1, 1931
233 App. Div. 799 (N.Y. App. Div. 1931)

Opinion

May, 1931.

Present — Sears, P.J., Crouch, Edgcomb, Thompson and Crosby, JJ.

Judgment and order affirmed, with costs. All concur, except Sears, P.J., and Edgcomb, J., who dissent and vote for reversal on the facts and for granting a new trial, on the ground that the verdict, so far as it found that the plaintiff's release was executed under duress, is against the weight of the evidence.
