It is Ordered that plaintiffs-respondents' motion to dismiss the appeal is denied. Defendant-appellant is directed to perfect its appeal by no later than the September 2014 term of this Court - the filing deadline is July 9, 2014, the time to serve and file respondent's brief is July 31, 2014 and reply brief, if any, is to be served and filed by August 7, 2014. In the event of defendant-appellant's failure to comply with the foregoing condition, plaintiff-respondent may move, on five days' notice, for an order dismissing the appeal.
