Niven v. Goldfarb Abrandt Salzman Kutzin, LLP

Appellate Term of the Supreme Court of New York, First Department
Oct 7, 2004
2004 N.Y. Slip Op. 51182 (N.Y. App. Term 2004)

Opinion

570200/04.

Decided October 7, 2004.

Plaintiff appeals from a judgment of the Small Claims Part of the Civil Court of the City of New York, Bronx County, entered on or about October 22, 2003 after trial (Francis M. Alessandro, J.) in favor of defendant dismissing the action.

Judgment entered on or about October 22, 2003 (Francis M. Alessandro, J.) affirmed, without costs.

PRESENT: HON. WILLIAM J. DAVIS, J.P., HON. PHYLLIS GANGEL-JACOB, HON. MARTIN SCHOENFELD, Justices.

The record and the ends of "substantial justice" (CCA 1804, 1807) support the dismissal after trial of this small claims action. Plaintiff offered no persuasive evidence to support his allegations that the defendant law firm overbilled him or acted in less than a "professional manner" in obtaining a favorable result in the underlying Medicaid dispute.

This constitutes the decision and order of the court.
