Opinion

CASE NO. 272 CRD-1-83

MAY 11, 1987

The claimant was represented by James L. Kestell, Esq., Kestell, Pogue Gould.

The respondents were represented by Richard J. Kenny, Esq., Howard, Kohn, Sprague Fitzgerald.

This Petition for Review from the September 30, 1983 Finding and Award of the Commissioner at Large acting for the First District was heard April 26, 1985 before a Compensation Review Division panel consisting of the Commission Chairman, John Arcudi, and Commissioners Robin Waller and Rhoda Loeb.

OPINION

Claimant has appealed from the Finding and Dismissal issued September 30, 1983 by the Commissioner at Large acting for the First District. Claimant filed his Petition for Review October 7, 1983. However, claimant's Reasons for Appeal were not received until October 26, 1983. Administrative Regulation Sec. 31-301-2 requires that Reasons of Appeal must be filed within 10 days after the filing of the Petition for Review. Claimant has failed to comply with the filing procedure set forth in Sec. 31-301-2 and thus the appeal is dismissed. Domizio v. Domizio Enterprises, Inc., 3 Conn. Workers' Comp. Rev. Op. 19, 306 CRD-5-84 (1985).

We, therefore, dismiss the appeal.

Commissioners Robin Waller and Rhoda Loeb concur.
