FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE


Pursuant to the District Court's Order of Reference, entered July 23, 2004, Plaintiff's Motion for Judgment of Civil Contempt or, in the Alternative, Motion for Order to Show Cause, filed July 16, 2004, has been referred to the United States Magistrate Judge for hearing, if necessary, and for recommendation. This Court has been informed by Plaintiff's counsel that Plaintiff wishes to withdraw these motions at this time, but wishes to be able to re-file the motions at a later time. Therefore, this Court recommends that Plaintiff's motions be denied as moot, without prejudice. Accordingly, the hearing set for these motions on Thursday, January 20, 2005 is hereby cancelled.

SO RECOMMENDED.
