ORDER


This cause comes before the Court on an Application to Proceed in District Court Without Prepayment for Costs (Doc. No. 2) filed June 15, 2010.

On June 18, 2010, the United States Magistrate Judge issued a report (Doc. No. 5) recommending that this case be dismissed without prejudice and that Plaintiff be allowed to file an Amended Complaint within fourteen days from the date of entry of this order. It is additionally recommended that the Application to Proceed in District Court Without Prepayment for Costs (Doc. No. 2) be denied without prejudice to refiling it with the Amended Complaint. An Amended Complaint was filed on June 22, 2010. No objections to the Report and Recommendation have been filed. Therefore, it is ORDERED as follows:

1. The Report and Recommendation is CONFIRMED and ADOPTED as part of this Order.

2. The Application to Proceed in District Court Without Prepayment for Costs is DENIED without prejudice. Plaintiff may file a new application or pay the filing fee of $350.00 in full within 14 days from the date of this order.
