MEMORANDUM OPINION
By letter dated December 22, 2008, the Court notified appellant that his brief was overdue. We directed appellant to file his brief and extension motion within ten days or the appeal would be dismissed. To date, appellant has not filed either his brief or an extension motion. Accordingly, we dismiss the appeal. See Tex. R. App. P. 38.8(a).
