So much of the judgment that was entered on June 27, 1996, in favor of the superintendent on the plaintiff's claim that the conditions of his confinement violated the Eighth Amendment and art. 26 of the Declaration of Rights is vacated, and the matter is remanded to the Superior Court for further proceedings consistent with the memorandum and order of the Appeals Court. In all other respects, the judgment for the DOC defendants is affirmed. The judgment for the medical defendants is affirmed.
