Petitioner's Emergency Petition for Writ of Quo Warranto filed on September 26, 2011, and seeking to prohibit the Florida Department of Corrections, a state agency, from using the controlled substance sodium pentobarbital to execute capital inmates is hereby dismissed.

No motion for rehearing will be allowed.
