Appeal and cross appeal from certain parts of an order of Supreme Court, Onondaga County (Centra, J.), entered May 23, 2001, that, inter alia, granted the motion of defendants Village of Solvay and Village of Solvay Electric Department to dismiss the complaint against them and granted plaintiff's motion for partial summary judgment on liability against defendant AmeriCold Logistics, LLC.
