On September 19, 2023, Appellant NexGen Broadband, LLC filed a Motion to Extend Time to File Appellant's Brief, due on September 20, 2023. In its Motion, Appellant requested an "additional thirty (30) days from the date the complete supplemental clerk's record is filed to file its [] [b]rief." More than ten days have passed since the filing of Appellant's motion with no opposition filed in response.

Appellant's motion is granted. Appellant's brief is due on Friday, October 27, 2023, subject to a further extension if the supplemental record has not been filed by such date.

It is so ORDERED.
