PER CURIAM.

We treat this appeal as a petition for writ of mandamus. See Fla. R. App. P. 9.040(c) ; Pesut v. Miller, 773 So. 2d 1185, 1186 (Fla. 2d DCA 2000). Based on our conclusion that the trial court did not err in ratifying the general magistrate's report and recommendation, the petition is denied.

Denied.
