ORDER

¶1 Department II of the Court, composed of Chief Justice Fairhurst and Justices Madsen, Stephens, González and Yu, considered at its December 5, 2017, Motion Calendar whether review should be granted pursuant to RAP 13.4(b) and unanimously agreed that the following order be entered.

¶2 IT IS ORDERED:

¶3 That the petition for review is denied and Respondent William Newcomer's request for attorney fees and costs is granted. Respondent William Newcomer is awarded reasonable attorney fees, costs and expenses pursuant to RAP 18.1(j). The amount of the attorney fees, costs and expenses will be determined by the Supreme Court Clerk pursuant to RAP 18.1.
