ORDER TO SHOW CAUSE

On December 27, 2022, respondent filed a Motion to Dismiss for Failure to Properly Prosecute As to Petitioner Adam Robert Newcomb.

On December 27, 2022, respondent and Petitioner, Whitney Lane Newcomb, filed a Stipulation of Settled Issues.

This case was called from the calendar of the Court's Louisville, Kentucky trial session on January 17, 2023. There was no appearance by or on behalf of the petitioners. Counsel for respondent appeared and was heard. After due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that petitioner, Adam Robert Newcomb, on or before February 16, 2023, show cause in writing why respondent's December 27, 2022 motion to dismiss for failure to properly prosecute should not be granted and a decision entered. It is further

ORDERED that, the Clerk of the Court shall serve a copy of the Show Cause Order on petitioners at the following addresses: Adam Robert Newcomb, 7456 Dr. Hodge Rd. Henderson, KY 42420, Whitney Lane Newcomb, 5945 Hwy. 136 W. Henderson, KY 42420 and 3140 Harness Loop Owensboro, KY 42303.
