SUMMARY JUDGMENT


The parties have filed cross-motions for summary judgment, and the issues having been heard and a decision rendered,

THE COURT ORDERS, ADJUDGES and DECREES that Plaintiffs have standing to challenge the constitutionality of Nev. Rev. Stat. §§ 294A.345, 281.477, and 281.551 on behalf of themselves and their members,

THE COURT ORDERS, ADJUDGES and DECREES that Nev. Rev. Stat. § 294A.345 is unconstitutional on its face,

THE COURT ORDERS, ADJUDGES and DECREES that the finding of a violation of Nev. Rev. Stat. § 294A.345 pursuant to Nev. Rev. Stat. § 281.477 violates the due process clause of the Fourteenth Amendment,

THE COURT ORDERS, ADJUDGES and DECREES that the enforcement of §§ Nev. Rev. Stat. § 294A.345 is hereby enjoined.
