BYRON NELSON, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 292nd Judicial District Court Dallas County, Texas Trial Court Cause No. F22-55497

ORDER

ROBERT D. BURNS, III CHIEF JUSTICE

Appellant's brief is overdue. Appellant's brief was originally due May 27, 2024. On May 29, 2024, this Court notified appellant's counsel that the brief was overdue and directed him to file appellant's brief and a motion for extension of time to file the brief within ten days. As of the date of this order, neither appellant's brief nor a motion for extension of time to file the brief have been filed.

We ORDER appellant's counsel, Daniel Oliphant, to file appellant's brief and motion for extension of time to file the brief on or before JULY 12, 2024. If appellant's brief and the motion for extension of time to file the brief are not filed by that date, the appeal may be abated for the trial court to make findings and recommendations pursuant to Rule of Appellate Procedure 38.8(b)(2), including whether Mr. Oliphant should be removed from representing appellant.
