DEREK A. NELSON, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 416th Judicial District Court Collin County, Texas
Trial Court Cause No. 416-80609-2014

ORDER

The Court REINSTATES this appeal.

On December 7, 2016, we ordered the trial court to make findings regarding why the reporter's record has not been filed. We ADOPT the findings that: (1) appellant desires to pursue the appeal; (2) appellant is indigent and represented by court-appointed counsel Justin Wilson; (3) counsel's explanation for the delay in filing appellant's brief is due to his workload; and (4) counsel requests an extension to January 13, 2017.

We ORDER appellant to file his brief on or before January 13, 2017.
