Based on the respondent's proper confession of error, the petition for writ of certiorari is granted. The trial court's Uniform Order Setting Cause for Jury Trial, Pre–Trial Conference and Pre–Trial Instructions dated November 14, 2012 hereby quashed, and the cause is remanded to the trial court so that the matter may be re-noticed for trial at a future date in accordance with Florida Rule of Civil Procedure 1.440.
