ORDER


This Court, having considered the Federal Defendants' Unopposed Motion for Extension of Time in which to file their Cross-Motion/Opposition to Plaintiff's Motion for Summary Judgment finds that such motion should be granted;

IT IS THEREFORE ORDERED that the Court's prior Scheduling Order dated November 12, 2002 be amended as follows:

1. On March 6, 2003, the Federal Defendants shall file their combined Cross-Motion for Summary Judgment and a Response to Plaintiff's' Motion for Summary Judgment, The Memorandum of Points and Authorities may not exceed fifty (50) pages. The Statement of Material Facts Not in Dispute may not exceed ten (10) pages;
2. All parties permitted by the Court to file amid curiae briefs shall file their briefs no later than March 17, 2003;
3. On April 4, 2003, Plaintiff's shall file their combined Response to Defendants' Cross-Motion for Summary Judgment and Reply to Defendants' Opposition to Plaintiff's Motion for Summary judgment Plaintiff's combined Response and Reply is allotted thirty (30) pages, but may not exceed forty (40) pages if extra pages are available (See Paragraph 6 below for page limit explanation);
4. On April 24, 2003, the Federal Defendants shall file their Reply to Plaintiff's Opposition to Defendants' Cross-Motion for Summary Judgment. The Federal Defendants' Reply is allotted twenty (20) pages, but may not exceed thirty (30) pages if extra pages are available. (See Paragraph 6 below for page limit explanation);
5. Oral argument in this matter shall remain as previously scheduled on May 9, 2003; and
6. Plaintiff's and the Federal Defendants may not exceed seventy (70) pages of briefing in their two filings, respectively. However, pages unused by either party in their initial Memorandum of Points and Authorities may be applied to their second filing.
