Dear Judge Kaplan:

With defendant's consent, plaintiffs in the above-captioned case write to respectfully request an extension of time to submit any bill of costs and application for attorneys' fees that may currently be required to be submitted by August 22, 2005. This is the first request for an extension.

Defendant took an interlocutory appeal from the Court's October 14, 2004 order requiring disclosure (with limited redactions) of an April 2002 opinion of defendant's Office of Legal Counsel. The Court of Appeals affirmed, and its mandate issued on July 22, 2005. To the extent that the Local Rules may require an application for costs and fees within 30 days of the mandate issuing, we respectfully request an extension up to and including October 6, 2005.

Plaintiffs seek this extension with the consent of the government so that the parties may attempt to resolve all issues relating to costs and attorneys' fees without the need for further litigation or other involvement of the Court.
