Had cargo damage been suffered because of the engine malfunction in the instant case, COGSA would control the rights, responsibilities, and liabilities of the parties. Id.; see also Narcissus Shipping Corp. v. Armada Reefers, Ltd., 950 F. Supp. 1129, 1141 (M.D. Fla. 1997), amended, 986 F. Supp. 1383 (M.D. Fla. 1997). However, absent cargo damage, COGSA does not govern the parties' dispute.
