After Remandment from the Supreme Court of Alabama.


The judgment of conviction of the appellant is reversed and the cause remanded on authority of the decision of the Alabama Supreme Court in Napier v. State, 357 So.2d 1011 (1978).

REVERSED AND REMANDED.

All Judges concur.
