ORDER DISMISSING APPEAL


This court having attempted to inform Defendant-Appellant Amos P. Naone by letter dated January 29, 2002, that the record on appeal is in default and that pursuant to Rule 11(a) of the Hawai`i Rules of Appellate Procedure the matter would be called to the attention of the court for such action as the court deemed proper; and said letter having been returned with a notation, "Not Deliverable as Addressed[;] Unable to Forward"; therefore,

IT IS HEREBY ORDERED that this appeal is dismissed.
