This action has been dismissed without prejudice to refiling. Judgment is entered accordingly.

DISMISSAL FOR FAILURE TO PROSECUTE AND FAILURE TO NOTIFY COURT OF ADDRESS CHANGE

This Court has reviewed de novo the files and records in this case, and the Report and Recommendation issued by Magistrate Judge Bernard Zimmerman. This Court concurs in Judge Zimmerman's findings and analysis; and finds that plaintiff Robert Myers has failed properly to prosecute this action in violation of Federal Rule of Civil Procedure 41(b) and has failed to notify the Court of his current address in violation of Local Rule 3-11.

Accordingly, this action is DISMISSED WITHOUT PREJUDICE.

IT IS SO ORDERED.
