(2) DISMISSING PLAINTIFF'S CLAIMS AGAINST DEFENDANTS THE OHIO
DEPARTMENT OF REHABILITION AND CORRECTIONS, THE WARDEN OF
LEBANON CORRECTIONAL INSTITUTION AND THE LEBANON
CORRECTIONAL INSTITUTION MEDICAL DEPARTMENT
This case is before the Court on the Order and Report and Recommendation of United States Magistrate Judge Karen L. Litkovitz. (Doc. 4). The Magistrate Judge recommends that the Court dismiss Plaintiff's claims against Defendants the Ohio Department of Rehabilitation, the Warden of Lebanon Correctional Institution, and the Medical Department of Lebanon Correctional Institution. (Id.) Plaintiff filed no objections to the Order and Report and Recommendation of the Magistrate Judge and the time for doing so has expired. The issues are now ripe for decision by the Court.
As required by 28 U.S.C. § 636(b) and Fed. R. Civ. P. 72(b), upon a de novo review of Plaintiff's filings and the comprehensive findings of the Magistrate Judge, the Court: (1) ADOPTS the recommendations set forth in the Order and Report and Recommendation of the Magistrate Judge in their entirety (Doc. 4); (2) DISMISSES Plaintiff's claims against Defendants the Ohio Department of Rehabilitation, the Warden of Lebanon Correctional Institution, and the Medical Department of Lebanon Correctional Institution. This case shall proceed as set forth in the Order and Report and Recommendation of the Magistrate Judge.
