ORDER
We REINSTATE this appeal.
Because no clerk's record had been filed, we ordered the trial court to conduct a hearing to determine whether (1) appellant is indigent and entitled to court-appointed counsel in this appeal and (2) either of the two attorneys who have filed documents in the Court of Appeals is representing appellant in the appeal. On March 28, 2017, the clerk's record was filed. After reviewing the record, it appears that Paul Dennis Key is currently retained counsel of record for appellant. We DIRECT the Clerk to remove Mr. Haley as counsel. Because findings are no longer necessary, we VACATE that portion of our March 23, 2017 order requiring a hearing.
By letter dated March 21, 2017, court reporter Kristen Kopp's informed the Court she has "received no request in writing to prepare the Reporter's Record" and "there have been no arrangements with the reporter to pay a fee for the preparation of the Reporter's Record." Therefore, we ORDER Paul Key to provide this Court, within TEN DAYS of the date of this order, with written proof he has requested and paid or made arrangements to pay for the reporter's record. The failure to do so will result in this appeal being submitted without a reporter's record. See TEX. R. APP. P. 37.3 (c).
We DIRECT the Clerk to send copies of this order to the Honorable Barnett Walker, Presiding Judge, County Court at Law No. 2; Kristen Kopp, official court reporter, County Court at Law No. 2; Leon Haley, Jr.; Paul Dennis Key; and the Collin County District Attorney's Office.
