Nature of Action: A temporary reduction in public assistance was effected on the grounds that the recipient of the assistance had received income from certain checks she endorsed although she had not received any personal benefit from the checks.

Superior Court: The Superior Court for Spokane County, No. 218423, William J. Grant, J., on January 14, 1975( entered a judgment upholding the temporary reduction. Court of Appeals: An opinion affirming the trial court was filed and reported at 15 Wn. App. 292. In the light of a subsequent Supreme Court opinion, the court now dismisses the appeal and withdraws its prior opinion.

PER CURIAM.

This matter is before the court on the stipulated motion of the parties to withdraw (1) our opinion Mulvey v. Department of Social Health Servs., 15 Wn. App. 292, 548 P.2d 597 (1976), and (2) the original appeal because Anderson v. Morris, 87 Wn.2d 706, 558 P.2d 155 (1976), decided subsequent to our opinion, furnished the parties with a basis for the amicable resolution of Mrs. Mulvey's claim. Therefore, our prior opinion is withdrawn and the appeal is dismissed.
