PRESENT:

Petitioners having moved for permission to re-file their brief filed in this CPLR article 78 proceeding transferred to this Court by an order of Supreme Court entered in the Office of the Clerk of the County of Erie on August 7, 2017,

Now, upon reading and filing the statement of Jacob A. Piorkowski, Esq., dated October 2, 2017, the amended affirmation of Jacob A. Piorkowski, Esq., dated October 5, 2017, the affidavit of Alicia Abbey sworn to October 3, 2017, the notice of motion with proof of service thereof, and the affirmation of David H. Walsh, Esq., dated October 17, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, on the condition that petitioners' replacement brief is filed and served in accordance with this Court's rules on or before October 30, 2017, and

It is further ORDERED that respondent's brief shall be filed and served in accordance with this Court's rules on or before November 29, 2017.
