Upon review of petitioner's response to this Court's order to show cause dated July 23, 2008, the Court has determined that it should decline to exercise jurisdiction in this case. See Lescher v. Fla. Dep't of Highway Safety Motor Vehicles, 985 So. 2d 1078 (Fla. 2008). The petition for discretionary review is therefore denied.

No motion for rehearing will be entertained by the Court. See Fla.R.App.P. 9.330(d).
