Opinion

CASE NO. 480 CRD-6-86

NOVEMBER 5, 1987

The claimant was represented by Donald H. Clark, Esq., Law Offices of Camp, Williams Richardson.

The respondents were represented by Robert M. Brennan, Esq. and Nancy Rosenbaum, Esq., Law Offices of Rosenbaum Brennan.

This Petition for Review from the April 25, 1986 Finding and Award of the Commissioner at Large acting for the Sixth District was heard October 2, 1987 before a Compensation Review Division panel consisting of the Commission Chairman, John Arcudi, and Commissioners Rhoda Loeb and Frank J. Verrilli.

FINDING AND AWARD

The April 25, 1986 Finding and Award of the Commissioner at Large is affirmed and adopted as the Finding and Award of this Division.

OPINION

A previous appeal in this matter, 419 CRD-6-85, does not involve the issue raised in the present case. The Commissioner below in his April 25, 1986 Finding and Award awarded temporary total benefits for the periods April 2 to May 27, 1985 and June 18 to July 2, 1985. The claimant-appellant argues he should have been granted those benefits from April 1 through September 17, 1985.

There was evidence below in the deposition of Dr. Arthur J. Driscoll of Bristol to support the Commissioner's findings, Adzima v. UAC/Norden Division, 177 Conn. 107, 118 (1979). Therefore, we affirm the April 25, 1986 Finding and Award of the Commissioner at Large acting for the Sixth District.

Commissioners Rhoda Loeb and Frank J. Verrilli concur.
