Motion by the appellants on an appeal from an order and judgment (one paper) of the Supreme Court, Kings County, dated September 29, 1998, to strike stated portions of the respondent's brief on the ground, inter alia, that it contains misstatements of fact. By decision and order on motion dated July 21, 1 999, the motion was held in abeyance and referred to the Justices hearing the appeal for determination upon the argument or submission of the appeal.


DECISION ORDER ON MOTION

Upon papers filed in support of the motion, the papers filed in opposition thereto, and upon the argument of the appeal, it is

ORDERED that the motion is denied.
