CRAIG MUELLER, AN INDIVIDUAL, Appellant, v. JOSEPH LOMBARDO, PUTATIVE REPUBLICAN CANDIDATE FOR GOVERNOR OF NEVADA, Respondent.

UNPUBLISHED OPINION

ORDER DISMISSING APPEAL

This is an appeal from a district court order awarding costs and from district court orders awarding attorney fees as sanctions. First Judicial District Court, Carson City; James E. Wilson, Judge.

This court ordered appellant to show cause why this appeal should not be dismissed for lack of jurisdiction. In particular, it appeared that appellant lacks standing to appeal because he was not a party to the underlying district court proceedings. See NRAP 3A(a); Valley Bank of Nevada v. Ginsburg, 110 Nev. 440, 448, 874 P.2d 729, 735 (1994); Watson Rounds v. Eighth Judicial Dist. Court, 131 Nev. 783, 786, 358 P.3d 228, 231 (2015). Appellant has now filed a motion to withdraw his appeal, "in recognition of this Court's rulings in Valley Bank of Nevada and Watson Rounds . . . T Respondent does not oppose the motion. Accordingly, this court grants the motion and dismisses this appeal. Each party shall bear their own costs and attorney fees. NRAP 42(b).

It is so ORDERED.

Hon. James E. Wilson, District Judge
