Timothy Muccilli appeals the district court's Federal Rule of Civil Procedure 12(b)(6) dismissal of his 42 U.S.C. § 1983 complaint. Upon de novo review, see Reis v. Walker, 491 F.3d 868, 870 (8th Cir. 2007), we conclude that dismissal was proper for the reasons stated by the district court.

The Honorable Patrick J. Schiltz, United States District Judge for the District of Minnesota, adopting the report and recommendations of the Honorable Raymond L. Erickson, United States Magistrate Judge for the District of Minnesota.

The judgment is affirmed. See 8th Cir. R. 47B.
