MSM Golf, L.L.C. v. Newgent

District Court of Appeal of Florida, Fifth District
May 3, 2002
814 So. 2d 1263 (Fla. Dist. Ct. App. 2002)

Opinion

No. 5D01-1537.

May 3, 2002.

Appeal from the Circuit Court for Brevard County, Charles M. Holcomb, Judge.

Allan P. Whitehead, of Frese, Nash Hansen, P.A., Melbourne, for Appellant.

Scott E. Damon and Eric S. Golden, of Baker Hostetler, LLP, Orlando, for Appellees.

MSM Golf, L.L.C. ["MSM Golf"] appeals a summary final judgment entered in favor of Classical Financial Services, L.L.C. ["Classical"], one of the defendants below. We affirm because the record does not support MSM Golf's claim that Classical was engaged in a joint venture with its borrower, Newgent, nor is there a genuine issue of fact concerning MSM Golf's claim of conspiracy to defraud.

AFFIRMED.

PETERSON and PLEUS, JJ., concur.
