This case is calendared for trial at the Trial Session of the Court scheduled to commence on October 2, 2023, in Kansas City, Missouri.
On September 23, 2022, Petitioner timely filed with this Court a Petition to commence this case. On August 30, 2023, respondent filed with the Court a Motion to Dismiss for Lack of Prosecution, in which respondent informed the Court that petitioner died on January 31, 2023.
Upon due consideration, and for cause, it is
ORDERED that the caption of this case be amended to read "Frisco R. Morse, Deceased, Petitioner v. Commissioner of Internal Revenue, Respondent."
