Opinion filed January 8, 2009.

On Appeal from the 238th District Court Midland County, Texas, Trial Court Cause No. CV-46,715.

MEMORANDUM OPINION

Carol J. Morris filed a pro se appeal challenging the trial court's ruling sustaining the district clerk's contest of Morris's affidavit of inability to pay costs at the trial court level. We dismiss the appeal pursuant to TEX. R. APP. P. 42.3.

After receiving the notice of appeal, the clerk of this court wrote the parties advising them that it appeared that this court had no jurisdiction in this matter; directing Morris to respond by December 29, 2008, and show grounds for continuing her appeal; and informing Morris that her appeal could be dismissed pursuant to TEX. R. APP. P. 42 absent a timely response. Morris has not responded to our December 11, 2008 letter.

Accordingly, the appeal is dismissed.
