Pending before the Court is petitioners' Motion to Proceed Remotely, filed May 25, 2023. Respondent filed a response to petitioner's motion on October 5, 2023, that states respondent does not object and describes the status of the case and reports that the parties have reached a basis of settlement. The Court encourages the parties to continue to cooperate in attempting to resolve the case by settlement, if possible.

Upon due consideration, it is

ORDERED that, unless the parties have submitted a proposed stipulated decision by December 5, 2023, then by that date, the parties shall file a joint status report (or separate reports, if a joint report is not possible), in which the parties shall therein describe the current status of the case and of the above-referenced pending motion.
