MEMORANDUM OPINION


On January 19, 2010, appellant Gary R. Morris filed a notice of appeal in this case. On January 21, 2010, we notified appellant that the $175 filing fee was due and that if appellant failed to pay the fee within ten days, the appeal would be dismissed. To date, appellant has not paid the filing fee. On February 10, 2010, appellant notified this court that he had abandoned his appeal.

Accordingly, we DISMISS this appeal. See Tex. R. App. P. 5, 42.3(c).
