MEMORANDUM OPINION


On September 29, 2003, this court issued an order abating this appeal because appellant, Morningstar Gas, Inc., was in bankruptcy. On May 27, 2005, appellant filed a motion to dismiss the appeal in accordance with the terms of the bankruptcy court's "Order Granting Joint Motion for Order Pursuant to Bankruptcy Rule 9019 Authorizing Compromise of Controversy" signed on May 10, 2005. The appeal is reinstated on the docket of this court. The motion is granted, and the appeal is dismissed.
