Morgan v. Shaff

Appellate Division of the Supreme Court of New York, First Department
Oct 16, 1951
279 App. Div. 573 (N.Y. App. Div. 1951)

Opinion

October 16, 1951.

Present — Peck, P.J., Dore, Cohn, Van Voorhis and Shientag, JJ.

Judgment unanimously reversed and a new trial ordered, with costs to the appellant to abide the event, unless plaintiff stipulates to reduce the verdict to $1,000, in which event the judgment, as so modified, is affirmed, without costs, upon the ground that the recovery, as reduced by the trial court, is excessive. Settle order on notice.
