MOTION AND PROCEDURAL RULINGS

On review of order certifying a conflict. The court determines that a conflict exists. The parties are to brief the issue as stated on page 5 of the court of appeals’ September 15, 2021 entry: "Is a change of circumstances under R.C. 3109.04 required in post-decree litigation between a parent seeking to regain custody of a child from a nonparent custodian when the parent voluntarily relinquished his or her right to legal custody by contractual agreement?" The conflict cases are Bragg v. Hatfield, 152 Ohio App.3d 174, 2003-Ohio-1441, 787 N.E.2d 44 (4th Dist.), and Anderson v. Anderson, 12th Dist. Warren No. CA2009-03-033, 2009-Ohio-5636.
