Bobby MORENO, Appellant v. THE STATE OF TEXAS, Appellee

From the 379th Judicial District Court, Bexar County, Texas

Trial Court No. 2011CR6663

Honorable Ron Rangel, Judge Presiding

ORDER

Sitting: Catherine Stone, Chief Justice

Karen Angelini, Justice

Rebeca C. Martinez

Counsel for appellant has filed a second motion to continue the oral argument setting in this appeal and a motion to withdraw from further representation of appellant. Upon further review of the briefs and record in this appeal, the Court has determined that the appeal is appropriate for submission on briefs. Accordingly, it is ORDERED that the appeal is withdrawn from submission on oral argument. The Court has further determined that, in this particular appeal, a suspension of the standard 21-day notice period is appropriate. See TEX. R. APP. P. 2, 39.8. Accordingly, the appeal is set for submission "on briefs" before this Court on July 10, 2013 before a panel consisting of Chief Justice Stone, Justice Angelini, and Justice Martinez. Counsel's motion for continuance is therefore DENIED. Finally, in accordance with the reasons set forth in our prior order dated June 25, 2013, counsel's motion to withdraw is also DENIED.

It is so ORDERED on the 8th day of July, 2013.

PER CURIAM ATTESTED TO: __________

Keith E. Hottle

Clerk of Court
