Sep 7, 2005
No. 05-05-00968-CV (Tex. App. Sep. 7, 2005)

Opinion

No. 05-05-00968-CV

Opinion Issued September 7, 2005.

On Appeal from the 256th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 00-00892-Z.

Dismissed.

Before Justices MORRIS, LANG, and MAZZANT.

MEMORANDUM OPINION

Alicia Moreno filed her notice of appeal on November 18, 2004 in the trial court. The district court forwarded her notice of appeal to this Court on July 12, 2005. Two days later, the Court sent appellant a letter, instructing her to file an amended notice of appeal. On August 5, 2005, we sent letters instructing appellant to file a docketing statement and pay her $125 filing fee. Both letters informed appellant her appeal would be dismissed if she failed to file a docketing statement or pay her filing fee. In August 2005, two of the Court's letters-one dated July 12, 2005 and the other dated July 14, 2005-were returned bearing the notations "RETURN TO SENDER ATTEMPTED — NOT KNOWN UNABLE TO FORWARD."

Because the Court is unable to contact appellant and because appellant has not made any attempt since the filing of her November 18, 2004 notice of appeal to prosecute this appeal, we DISMISS this appeal for want of prosecution. See Tex.R.App.P. 42.3.
