CIVIL NO. 2:02CV 347DAK
May 19, 2004
Bradford D. Myler, Orem, UT, for Plaintiff
ORDER
Based upon Plaintiff's Petition, Memorandum and Affidavit in Support EAJA Fees, and upon review of the record in the above referenced case; the Court now finds that the position of the United States was not substantially justified, that Plaintiff is the prevailing party, that plaintiff is eligible to receive an attorney fee award, and that the amount of requested Fees is reasonable. The court therefore orders that EAJA fees be paid to Plaintiff's lawyer in accordance with Plaintiff's petition, in the amount of $8,555.68, plus $112.25 in costs, for a total of $8,667.93. Payment shall be made to Plaintiff's lawyer on behalf of Plaintiff.
