Proceeding under the Workmen's Compensation Act by Everett M. Smiley against John A. Moore, contractor, and another. From an award of compensation against the contractor and his employer, they appeal. Affirmed. By the court in banc.

This is a companion case to Moore v. Copeland (1928), ante 54, 163 N.E. 235, and, on authority of that case, the award is affirmed.
