ORDER

This matter is before the court on Appellant Joseph Michael Mooney's Motion to Withdraw. Appellant moves to withdraw his appeal of the district court's dismissal of his 28 U.S.C. § 2241 petition.

Appellant's motion is construed as a motion for voluntary dismissal. So construed, the motion for voluntary dismissal is granted and this appeal is dismissed. See Fed. R. App. P. 42(b); 10th Cir. R. 27.5(A)(9).

A copy of this order shall stand as and for the mandate of the court.
