The Court has determined that it should decline to accept jurisdiction in this case. See Pena v. State, DONo. SC08-1161, 2008 WL 4292183 (Fla. Sept. 18, 2008) (denying review of Pena v. State, 980 So. 2d 542 (Fla. 4th DCA 2008)). The petition for discretionary review is therefore denied.
No motion for rehearing will be entertained by the Court. See Fla.R.App.P. 9.330(d).
