FRAUD AND DECEIT, § 46reliance on alleged representation as to farm's acreage. Even if vendor misrepresented number of acres in farm, vendor was not on that account liable to purchasers where one of them testified that prior to sale she had seen plat of farm indicating that there were less acres than allegedly represented by vendor, and purchasers had ample opportunity for investigating records of acreage before sale was consummated.

Appeal from the Circuit Court of Macon county; the Hon. CHARLES KELLER, Judge, presiding.

Affirmed in part, reversed in part and remanded with directions. Heard in this court at the May term, 1948.
