The petition for writ of habeas corpus is hereby dismissed without prejudice to the petitioner's right to refile his arguments in a motion for postconviction relief in the sentencing court pursuant to Florida Rule of Criminal Procedure 3.850, provided that such a motion would be timely filed and not otherwise procedurally barred.
